Modern commercial leases provide the opportunity to review the level of rent paid or received usually only once in every 5 year period. Leases usually expire on a less frequent basis. The outcome of such events is therefore equally important to both investors – seeking to maximise income and capital return – and to tenants – seeking to contain their operating costs. From both parties perspective obtaining the best advice is of paramount importance.

  • Advice on the implementation of lease renewal or rent review, the timing appropriate to implementation and advising on the right strategy to meet the objectives of individual clients;
  • The provision of an early indication of the appropriate level of rent calculated in accordance with the terms of the lease and having regard to prevailing market conditions;
  • Negotiating to achieve a satisfactory outcome for the client including, in the case of lease renewals, advice on the terms of the new lease and rent review provisions;
  • If a satisfactory settlement is not available through negotiation, representations – either written or oral – will be made to Arbitrator, Independent Expert or the Court.
